How to Apply for a Bay County Marriage License

Michigan law under MCL 551.101 requires that at least one applicant be a Bay County resident to apply at this office. If neither of you lives in Bay County but you plan to wed here, you still apply in the county of the ceremony. One person can apply on behalf of both parties. The second applicant does not need to be there in person. That means less time at the window if you plan ahead and bring everything.

The application is a sworn affidavit under MCL 551.102. Both parties' Social Security numbers are required. You sign under oath. Providing false information is treated as perjury under Michigan law, so every detail needs to be accurate. The clerk can answer questions, but the responsibility to file correctly is on the applicants.

Both applicants must be at least 18 years old. Anyone who is 16 or 17 needs written parental consent. Michigan does not allow anyone under 16 to marry.

Note: Only one applicant needs to appear at the Bay County Clerk's office to pick up the marriage license, as long as that person brings the required documents for both parties.

Documents to Bring to Bay County Clerk

Before you drive to 515 Center Ave., take a few minutes to gather the right papers. The clerk needs proof of identity, proof of age, proof of county residency, and documentation of any prior marriages. Come with everything and you'll be in and out quickly.

Plan to bring the following for both applicants:

  • Valid driver's license or state-issued ID with a current Bay County address
  • Birth certificate or passport to verify age
  • Social Security numbers for both parties
  • Divorce decree or death certificate if either party was previously married

If the ID address doesn't show a Bay County location, the clerk may apply the non-resident fee of $30. Out-of-county applicants are still eligible to apply, but the residency status affects the cost. Double-check your ID before heading to the office.

Bay County Marriage License Fees

Bay County charges $20 for Michigan residents and $30 for non-residents. State law sets these amounts. They are the same across most Michigan counties. Bring cash or check; call ahead at (989) 895-4296 if you need to confirm payment options.

After you get your Bay County marriage license, Michigan law under MCL 551.103a requires a three-day waiting period before the ceremony can take place. The clock starts the day the license is issued. The license is valid for 33 days from that same date. If your wedding is planned more than 33 days out, wait to apply. If it falls outside the validity window, the license expires and you'd need to apply again from scratch. Schedule carefully to stay within both the waiting period and the validity window.

Marriage Ceremonies in Bay County

Michigan's MCL 551.7 defines who can officiate a marriage in the state. Judges, magistrates, mayors, ministers, and county clerks are all authorized. That gives you a lot of options for your Bay County ceremony. Religious services, civil ceremonies, and outdoor events are all valid as long as the officiant is legally authorized.

After the ceremony, the officiant must sign the Bay County marriage license and return it to the clerk within 10 days under MCL 551.104. This is the officiant's legal responsibility, not yours. But it's worth reminding your officiant of this deadline before the wedding. A signed license that never gets returned can cause problems when you try to order a certified copy or prove your marriage legally. Confirm the return step is handled before the day is done.

Bay County falls under the judicial circuit that covers the area, and Bay City has local courts that may offer civil ceremony options for couples who prefer a quick courthouse wedding. Contact the court directly to ask about availability and scheduling.

Note: Under Michigan law, your officiant must return the signed marriage license to the Bay County Clerk within 10 days of the ceremony date.
