Both applicants must appear in person at the same time. You cannot send someone else in your place or apply by mail. Bring all required documents when you go so you don't have to make a second trip.

How to Apply for a Marriage License in Delta County

Both people who plan to marry must go to the clerk's office together. You fill out the application form there. The clerk will check your documents, collect the fee, and issue the license. The whole visit usually takes less than 30 minutes if your paperwork is in order.

After you receive the license, you must wait 3 days before the ceremony can take place. That waiting period starts the day you apply. For example, if you apply on a Monday, the earliest you can marry is Thursday. The 3-day period includes weekends and holidays, so plan your date accordingly.

Your license is valid for 33 days from the date of application. If you don't use it within that window, it expires and you would need to apply again and pay the fee a second time. Note: The waiting period can be waived by a judge or magistrate for an additional fee, though this is uncommon.

Required Documents

Both applicants must bring the same set of documents. Make sure everything is current and valid before your visit.

  • Valid government-issued photo ID showing your current address (driver's license or state ID)
  • Government-issued birth certificate (not a hospital copy)
  • Social Security number (card not always required, but you must know the number)
  • If previously married: certified divorce decree or death certificate for each prior marriage
  • Parents' full legal names and the states where they were born
  • If 16 or 17 years old: a parent or legal guardian must appear with you and give written consent

If your ID does not show your current address, bring a utility bill, lease, or other document that proves where you live. Non-residents who want to marry in Delta County can apply here even without a local address, but the fee is $30 instead of $20.

Fees and Waiting Period

The fee for a marriage license in Delta County is $20 for Michigan residents. Non-residents pay $30. Payment is typically accepted by cash or check; call the office to confirm if they take cards. The fee is not refunded if your plans change after you apply.

Michigan law sets the standard 3-day waiting period under MCL 551.101. The law also allows couples to ask a judge or magistrate to waive the wait. There is usually an additional fee for that, and it is up to the judge whether to grant it. Most couples simply plan around the waiting period rather than seek a waiver.

There are no additional county fees beyond the license fee. The ceremony itself can cost whatever you and your officiant arrange, but the county does not charge for that.

Getting Certified Copies of Your Marriage Record

Once your ceremony takes place, the officiant has 10 days to return the completed license to the Delta County Clerk. The clerk then registers the marriage. After that, the record exists both at the county and with the state.

For a certified copy from the state, contact the Michigan Department of Health and Human Services (MDHHS) Vital Records office. The MDHHS is at 333 S. Grand Ave, Lansing, MI 48933, and can be reached at (517) 335-8666. The first certified copy costs $34, and each additional copy ordered at the same time is $16. Rush processing adds $12 and typically takes 2 to 3 weeks. Standard requests take 4 to 5 weeks. You can order online through VitalChek via the MDHHS site, or visit in person by appointment on Tuesdays and Thursdays from 10:00 AM to 2:00 PM.

You can also get copies directly from the Delta County Clerk. County copies are often faster and less expensive. Contact the clerk's office for current fees and turnaround times for county-level copies.

The MDHHS has kept statewide marriage records since 1867. For older records, the Michiganology database offers free online access to historical Michigan vital records, which is useful for genealogy research.

Michigan Marriage License Law

Marriage licenses in Michigan are governed by state statute. MCL 551.101 sets out the basic requirements: both parties must apply in person, pay the fee, and wait 3 days. MCL 551.102 covers residency and where to apply. If either applicant is a Michigan resident, you apply in the county where they live. If neither lives in Michigan, apply in the county where the ceremony will take place.

Under MCL 551.7, people authorized to perform marriage ceremonies include judges, magistrates, mayors, county clerks, and ordained ministers. Two witnesses who are at least 18 years old must be present. The officiant signs the license and returns it to the county clerk within 10 days, as required by MCL 551.104.

The minimum age to marry is 18 without parental consent. Those who are 16 or 17 may marry with written parental consent. No one under 16 may marry in Michigan.

Name Change After Marriage

Your marriage license serves as legal proof of name change. Start with the Social Security Administration (SSA), which is free. After that, update your driver's license at the Michigan Secretary of State. Then notify your bank, employer, insurance company, and any other records that use your name. Most agencies want a certified copy of your marriage license as proof.
