How to Apply for a Marriage License
Both applicants must appear together at the clerk's office. You fill out the application form, present your documents, and pay the fee. The clerk reviews everything and, if approved, gives you the license the same day. The visit usually takes 15 to 30 minutes if your paperwork is complete.
Michigan law requires a 3-day waiting period before you can use the license. The wait starts on the day you apply. If you apply on a Monday, the first day you can marry is Thursday. Weekends and holidays count toward the 3 days, so keep that in mind when picking your ceremony date.
The license is valid for 33 days after the application date. If your ceremony doesn't happen in that window, the license expires and you must apply again and pay the fee a second time. Note: Waiting period waivers are possible but require a petition to a circuit court judge and may not be approved.
What to Bring
Each applicant must bring the same documents. Having everything ready before you go prevents delays.
- Valid government-issued photo ID with your current address (driver's license or state ID)
- Certified birth certificate issued by a government agency (not a hospital)
- Social Security number (bring your card if you have it)
- If previously married: a certified divorce decree or death certificate for each past marriage
- Parents' full legal names and the state each parent was born in
- If you are 16 or 17 years old: a parent or legal guardian must come and provide consent
If your ID doesn't show your current address, a recent utility bill or lease agreement can fill that gap. Non-residents who will hold the ceremony in Eaton County can also apply here, but the fee is $30 rather than $20.
Fees and the Waiting Period
The standard fee for Eaton County residents is $20. Non-residents pay $30. This fee is set under MCL 551.101. It is collected when you apply and is not refundable.
The 3-day waiting period cannot be skipped without a court order. If you have a pressing reason to waive it, you need to file a petition with the Eaton County Circuit Court. The court charges a fee, and a judge must agree. Most couples simply factor the waiting period into their planning. There are no other fees owed to the county beyond the license fee itself.
Certified Copies of Your Marriage Record
After the ceremony, the officiant signs the license and has 10 days to return it to the Eaton County Clerk under MCL 551.104. The clerk records the marriage. Once registered, the record is available both locally and through the state's vital records system.
For a state-certified copy, reach out to the Michigan Department of Health and Human Services (MDHHS) Vital Records office at 333 S. Grand Ave, Lansing, MI 48933, phone (517) 335-8666. The first certified copy is $34. Additional copies ordered at the same time are $16 each. Rush processing adds $12 and takes about 2 to 3 weeks. Standard orders take 4 to 5 weeks. You can order online at michigan.gov/mdhhs through VitalChek, or visit in person by appointment on Tuesdays and Thursdays from 10:00 AM to 2:00 PM at the Lansing office.
You may also request copies directly from the Eaton County Clerk's office. County records are often a faster and cheaper option for couples who live nearby. Call the clerk to ask about current fees and processing times for county-level copies.
Michigan Marriage License Laws
Marriage in Michigan is regulated at the state level. MCL 551.101 establishes who can marry and the in-person application requirement. MCL 551.102 explains where to apply: residents apply in their county of residence, and non-residents apply in the county where the ceremony will occur.
Permitted officiants under MCL 551.7 include judges, magistrates, mayors, county clerks, and ordained ministers. Two adult witnesses (18 or older) must be present at every ceremony. The officiant signs the license and must return it to the county clerk within 10 days per MCL 551.104.
You must be 18 to marry without any additional steps. Those ages 16 or 17 need parental consent. No one younger than 16 may marry in Michigan.
Changing Your Name After Marriage
Your signed and certified marriage license is your legal proof of name change. Begin at the Social Security Administration, where the process is free. Then visit a Michigan Secretary of State office to update your driver's license. After that, update your name with your bank, employer, insurance company, and anyone else who needs to know. Keep a few certified copies of the marriage record on hand since many places will ask to see one.
