How to Apply

Both people getting married go to the clerk's office together. You complete the application there, show your documents, and pay the fee. If everything checks out, you get the license the same day. Most visits are done in under 30 minutes.

A 3-day waiting period is required by Michigan law. It begins on the day you apply. Apply on a Monday, and the first day you can legally hold the ceremony is Thursday. Weekends and holidays count toward those 3 days. Factor this in when you pick your ceremony date.

The license is valid for 33 days. If the ceremony doesn't happen before it expires, you lose the license and must reapply. Note: A court can waive the 3-day wait if you have urgent circumstances, but that requires filing a petition with the Houghton County Circuit Court and paying a court fee.

Required Documents

Each applicant must bring all of the following. Both people need their own full set of documents.

  • Valid government-issued photo ID with current address (driver's license or state ID)
  • Government-issued birth certificate (certified copy, not a hospital record)
  • Social Security number (bring your card if you have it)
  • Certified divorce decree or death certificate for each previous marriage
  • Full legal names of both parents and the state each was born in
  • If 16 or 17: a parent or guardian must come with you and provide written consent

If your photo ID doesn't show your current address, a recent utility bill or bank statement works as backup proof. Michigan residents pay $20; non-residents pay $30. Confirm payment types with the clerk before your trip.

Fees and Waiting Period

Houghton County charges the standard Michigan fee of $20 for residents and $30 for non-residents. The fee is based on MCL 551.101. You pay at the time of application, and no refunds are given regardless of what happens afterward.

The 3-day wait is statewide. Houghton County follows it like all other Michigan counties. If you need to skip it, you must go through the circuit court. A judge will decide. Most couples simply schedule their wedding date at least 3 days after their planned application date.

Certified Copies of Your Marriage Record

After your ceremony, the person who performed it must sign the license and return it to the Houghton County Clerk within 10 days. This is a firm requirement under MCL 551.104. The clerk records the marriage locally and submits the data to the state.

To get a certified copy from the state, contact the Michigan Department of Health and Human Services (MDHHS) at 333 S. Grand Ave, Lansing, MI 48933 or (517) 335-8666. The first copy is $34. Additional copies ordered at the same time are $16 each. Rush service adds $12 and reduces the wait to 2 to 3 weeks. Standard orders take 4 to 5 weeks. You can order through the MDHHS VitalChek portal, or visit in person by appointment on Tuesdays and Thursdays from 10:00 AM to 2:00 PM.

Michigan Marriage License Laws

All Michigan counties follow the same state statutes for marriage licenses. MCL 551.101 sets the in-person application requirement, the 3-day wait, and the 33-day validity. MCL 551.102 tells you where to apply. Residents apply in their county of residence; non-residents apply where the ceremony will be held.

Officiants authorized under MCL 551.7 include judges, magistrates, mayors, county clerks, and ordained ministers. The ceremony requires two witnesses who are at least 18. The officiant must return the signed license to the county clerk within 10 days per MCL 551.104.

Minimum age to marry in Michigan: 18 without consent; 16 or 17 with parental consent; no one under 16 may marry.

Name Change After Marriage

Your certified marriage record is your proof for a name change. Begin at the Social Security Administration (free). Then update your driver's license at a Michigan Secretary of State office. After that, contact your bank, employer, insurance company, and other institutions. Most want to see a certified copy of the marriage license.
