How to Apply for a Wayne County Marriage License

Under MCL 551.101, at least one of you must be a Wayne County resident to apply here. If neither of you lives in Wayne County but you plan to have your ceremony here, you apply in the county where the wedding will take place. Non-residents pay a higher fee. Only one person needs to visit the office in person; that person can bring the required documents for both parties. The other person does not need to be present at the time of application.

Wayne County also offers an online application. You can complete the form at the Wayne County Marriage Application portal before your visit to save time at the counter. The application itself is a sworn affidavit under MCL 551.102, which means both parties must provide their Social Security numbers and sign under oath. False statements on the application are treated as perjury under Michigan law.

Both applicants must be at least 18 years old. If one party is 16 or 17, parental consent is required. No one under 16 may legally marry in Michigan.

Note: The Wayne County online filing portal lets you begin your marriage license application before visiting the clerk's office in person.

Required Documents for Wayne County Marriage License

Come prepared. The clerk's office will ask for specific documents to verify your identity and address. Missing paperwork means a return trip, so it's worth double-checking the list before you go.

You will need to bring:

  • Valid driver's license or state-issued ID showing your current Wayne County address
  • Birth certificate or passport for age verification
  • Social Security numbers for both parties
  • Any divorce decrees or death certificates if previously married

If one person is bringing documents for both, that person should have all of the above for each applicant. The clerk verifies the address on the ID matches a Wayne County location. Out-of-county residents can still apply but will pay the non-resident fee of $30.

Wayne County Marriage License Fees and Waiting Period

The fee for a Wayne County marriage license is $20 for Michigan residents and $30 for non-residents. These fees are set by state law and are standard across most Michigan counties. Wayne County also charges $10 for a waiting period waiver if you need to skip the standard three-day wait.

After the clerk issues your license, you must wait three days before your ceremony can take place. This is required by Michigan law under MCL 551.103a. The license is valid for 33 days from the date it was issued. If your wedding falls outside that window, the license expires and you'll need to apply again. Plan ahead to avoid scheduling conflicts with the validity window.

The fee is $10, and you must call (313) 965-2790 to schedule your appointment. You need a valid Wayne County marriage license and two witnesses who are at least 18 years old.

Under Michigan Courts guidelines, MCL 551.7 lists who can legally perform a marriage in Michigan. This includes judges, magistrates, mayors, ordained ministers, and county clerks. Make sure your officiant is legally authorized and that the signed license gets returned to the clerk within 10 days of the ceremony as required by MCL 551.104.

Note: Wednesdays are the only day the 36th District Court holds civil ceremonies at the Coleman A. Young Municipal Center.

For older records and certified copies of marriage certificates, the Michigan Department of Health and Human Services (MDHHS) maintains statewide vital records going back to 1867. A certified copy from the state costs $34 for the first copy and $16 for each additional copy. Rush processing adds $12. Contact MDHHS Vital Records by phone at (517) 335-8666 or visit the site to order online or by mail.

For historical marriage records, Michiganology offers a free searchable database of older Michigan vital records, which can be useful for genealogy research involving Wayne County families. You can also search through Vital Records Online Michigan for an additional option.

After that, update your driver's license or state ID through the Michigan Secretary of State. You'll need your updated Social Security card and your certified marriage certificate.
