How to Apply for a Marriage License in Waterford Township

Both you and your partner go to the Oakland County Clerk together. You fill out the application, show your documents, and pay. The three-day waiting period starts that day. Michigan law under MCL 551.101 requires this wait before the license is valid. A judge can waive it for an extra fee, but it's not automatic.

Once the wait is over, the license is valid for 33 days. Your ceremony must happen in that window. If you let the 33 days lapse, the license expires and you start over. Most Waterford Township couples apply about a week before their ceremony to give some room without risking expiration.

After the ceremony, the officiant must return the completed and signed license to the Oakland County Clerk within 10 days (MCL 551.104). Two witnesses who are 18 or older must sign at the ceremony. Review these rules with your officiant ahead of time so nothing slips through the cracks.

Required Documents

Both applicants must bring the full set of documents. One missing item means the clerk cannot process the application that day.

  • Valid government-issued photo ID with your current Waterford Township address (Michigan driver's license or state ID)
  • Certified birth certificate from a government vital records office (hospital birth records are not accepted)
  • Social Security number for each applicant
  • If previously married: certified divorce decree or death certificate for the former spouse
  • Full names and birth states of both parents for each applicant

The certified birth certificate is the most common reason for a failed application. A hospital birth record doesn't qualify. You need the certified version issued by the vital records office of the state where you were born. Michigan residents can request this from the MDHHS at (517) 335-8666. Anyone born in another state needs to contact that state's vital records office directly.

Don't wait on this. Some states can process in a week; others take much longer. If you need to order your birth certificate, start that process before you settle on a ceremony date. You don't want document processing to push your wedding back.

If you were previously married, bring a certified copy of your divorce decree or your late spouse's death certificate. Photocopies may not be enough. Call the Oakland County Clerk at (248) 858-0571 to confirm what format is needed.

Note: You must be 18 or older to apply without parental consent. Applicants ages 16 and 17 can apply with written parental approval. No one under 16 can receive a Michigan marriage license.

Fees and Waiting Period

Oakland County charges $20 for residents and $30 for non-residents. Waterford Township residents qualify for the $20 resident rate. If your partner lives outside Oakland County, they may be classified as a non-resident. Call the clerk to confirm if this applies to your situation.

The three-day wait starts on application day. Apply on Wednesday; Saturday is the earliest valid ceremony day. Count carefully if your ceremony venue has a set date. Confirm with the clerk if holidays fall within your three-day window.

Oakland County's waiting period waiver fee is $5, which is among the lowest in the state. To skip the wait, petition a judge and pay $5 in addition to the license fee. Total cost with waiver: $25 for a resident. Waivers are at the judge's discretion and are not guaranteed.

Certified copies from Oakland County cost $15 for the first and $5 for each additional copy. Order multiple copies when you first apply; the per-copy cost for additional copies is low and you'll want extras for name changes and insurance updates.

Note: Confirm current fees at (248) 858-0571 before your visit since amounts can change.
