Emmet County is a popular destination for weddings, especially in the summer. If you are planning a ceremony in the area and neither partner lives in Emmet County, you can still apply here because the ceremony will take place in this county. Call the office if you have any questions about eligibility before you make the drive.
How to Apply
Both applicants go to the clerk's office together, complete the application, and hand over the required documents and fee. The clerk reviews everything on the spot. If everything checks out, you receive your license before you leave. Plan on spending about 20 to 30 minutes at the office.
Michigan law requires a 3-day waiting period that starts on the day you apply. If you apply on a Friday, the first possible wedding day is Monday. The 3 days include weekends and holidays. It doesn't matter when during the day you apply; the count starts that calendar day.
Once issued, the license is valid for 33 days. If your ceremony is delayed past that window, the license expires. You would need to reapply and pay again. Note: If your timeline is very tight, you can ask a circuit court judge to waive the 3-day period, but this requires a petition and an additional court fee.
Required Documents
Each person in the couple must bring all of the following. Having your documents ready speeds up the process.
- Valid government-issued photo ID showing your current address
- Government-issued birth certificate (original or certified copy)
- Social Security number (bring the card if possible)
- Certified divorce decree or death certificate if either applicant was previously married
- Full legal names of both parents and the state each parent was born in
- If you are 16 or 17: a parent or guardian must appear in person and sign a consent form
If your ID doesn't reflect your current address, a utility bill, bank statement, or lease can serve as proof. Non-residents pay $30; residents pay $20. Bring the right payment method; call ahead to confirm what forms of payment the office accepts.
Marriage License Fees
Emmet County follows the Michigan standard fee schedule. Residents pay $20. Non-residents pay $30. These amounts are set under MCL 551.101. The fee is due at the time you apply and is not returned under any circumstances, including if you cancel the wedding.
There are no separate county surcharges on top of the state fee. The only additional cost you might face is a court fee if you seek a waiver of the 3-day waiting period. That fee goes to the circuit court, not the county clerk. Emmet County does not charge for verifying your documents or processing your application beyond the license fee.
Getting Certified Copies
Your officiant must sign the license after the ceremony and return it to the Emmet County Clerk within 10 days. This is a requirement under MCL 551.104. The clerk records the marriage and sends the data to the state's vital records system in Lansing.
For certified copies through the state, contact the Michigan Department of Health and Human Services (MDHHS) at 333 S. Grand Ave, Lansing, MI 48933 or call (517) 335-8666. The first copy is $34. Each additional copy is $16. Rush processing costs an extra $12 and takes 2 to 3 weeks; standard orders take 4 to 5 weeks. Order online through the MDHHS VitalChek portal, or visit in person by appointment Tuesdays and Thursdays from 10:00 AM to 2:00 PM.
Certified copies are also available from the Emmet County Clerk. Local copies tend to be faster and less expensive. Contact the clerk's office for current pricing and turnaround estimates.
Michigan Law and Who Can Marry You
Under Michigan statute, MCL 551.101 outlines the basic requirements for getting a marriage license, while MCL 551.102 sets out where to apply. Residents apply in their county of residence. Non-residents apply in the county where the ceremony will take place.
MCL 551.7 lists the people who can legally perform a marriage in Michigan: judges, magistrates, mayors, county clerks, and ordained ministers. Two adult witnesses (age 18 or older) must attend. The officiant must sign the license and return it to the clerk within 10 days.
Minimum age is 18 without extra steps. Ages 16 and 17 may marry with a parent's consent. No one under 16 may marry in Michigan.
After the Wedding: Name Change
To change your name after marriage, begin with the Social Security Administration. That step is free. Next, update your driver's license at a Michigan Secretary of State branch. Then move on to your bank, employer, insurance, and any other accounts. Keep a few certified copies of your marriage record handy since different agencies will want to see proof.
